A fee is payable upon the commencement of a proceeding (or proceedings) with the BAB.

We encourage all documents commencing a proceeding to be submitted electronically via email, rather than in hard copy form. If possible, payment should be made by credit card, due to longer processing times for payments made by cheque or money order.
Below you can find the form and current fee for your appeal, dispute referral, application or fast track appeal request. All fees are prescribed under regs 272 and 273 of the Building Regulations 2018 (Regulations). All fees received by or on behalf of the Building Appeals Board (BAB) are required to be paid into the building account of the Building and Plumbing Commission (BPC) fund pursuant to s 205A of the Building Act 1993 (Act), which is established pursuant to s 205 of the Act.

Due to security concerns, the BAB will not accept the filing of material on media such as a compact disc (CD), digital versatile disc (DVD) or universal serial bus (USB).
If you are filing large documents to the BAB, you may wish to consider emailing the documents to the registry of the BAB using a compressed (zipped) folder or via a file transfer platform such as Dropbox, Google drive, WeTransfer, etc. Please note if you are filing large documents by emailing a shared access link to a file transfer platform, please ensure that a password is not required to access the documents.
Please ensure that you use the most current version of our forms available on our website. If a previous version of a form is submitted to the BAB, you may be requested by registry staff to complete and submit the current version.

In accordance with s 248 of the Act, it is an offence for a person to act on behalf of an owner of a building or land in relation to an application made to the BAB without written authorisation.

Fee waiver requests
Regulation 274A(1) of the Regulations provides:
A person is exempt from having to pay the whole or part of a fee payable to the Building Appeals Board…if any of the persons referred to in subregulation (2) is satisfied that payment of the whole or part of the fee will cause the person to suffer financial hardship.
Those persons referred to in subregulation (2) are the Chairperson, Deputy Chairperson and Registrar of the BAB.
If payment of a fee payable will cause you to suffer financial hardship, you can request a fee waiver by submitting it in writing to the registry email along with supporting evidence such as a health care card (front and back) and income statement from Services Australia. If you are not eligible for a health care card, we may ask you to provide details of your present income, day to day living expenses and present liabilities and assets. The Registrar may ask for evidence supporting the particulars provided.
Please note these documents do not need to be served on the other parties to the proceeding(s) before the BAB.
Fee refund requests
The BPC may refund fees paid from the building account of the BPC fund in whole or in part if the appeal, dispute referral, application or fast track appeal request does not proceed (reg 274(1) of the Regulations). All requests for a refund of fees paid must be submitted in writing to the registry email. The BAB must refund from the building account of the BPC fund any fee paid for a request to fast track an appeal if the request is refused.
