Hearings and other listings

On this page you will find a record of listings of the Building Appeals Board (Board) including directions hearings, preliminary hearings, final hearings including 'paper hearings'*, mediations, site inspections and administrative mentions. All our hearings and mediations, unless otherwise directed, are conducted remotely using audio-visual conferencing technology.

For more information on how hearings are conducted, please refer to the following practice notes:

The listings published below are the listings in the week ahead.

With exception to some modification applications, listings in the week ahead are available from Friday by 4:15 PM in the week prior and are updated every weekday in the subsequent week by 4:15 PM.

Modification applications that are considered without the need for the parties to attend a hearing are usually considered on Thursday mornings. These listings will be made available by 4:15 PM on the day prior.

*Subject to a party requesting an oral hearing, a 'paper hearing' may be conducted if the Board considers it appropriate to make a determination in the proceeding 'on the papers' based on written submissions filed and evidence tendered by the parties, without the need for any party to appear before the Board.

All hearings conducted by the Board apart from paper hearings are open to the public unless ordered otherwise. If you wish to observe a hearing, please put your request in writing and include the case number and property address and email it to the registry email. To ensure the Board can accommodate your request, please make your written request not less than 48 hours prior to the listed hearing.

Information about site inspections

Inspections of sites are carried out at the discretion of the Board.

Submission of further information (including discussion of the case) must not occur during the inspection, unless requested by the Board.

Notice of an upcoming inspection will not be given unless access is required to the property, in which case the Board will advise all parties during the hearing.

Frequently asked questions

Can I get a transcript or audio recording of a hearing?

Whilst we cannot provide a written transcript of the hearing, we may provide an audio recording (if available). You must complete the   Audio Recording Request form  (PDF, 132.51 KB) that includes signing a undertaking and send this request to the registry email.

The request is then considered by the chairperson of the panel who presided at the hearing. If you intend to request an audio recording, please check with the case officer that the hearing will be recorded.

I am not able to attend my hearing. What do I do?

You may request that the hearing be adjourned to a later date. You should first contact the other parties to obtain their consent as early as possible by completing a Consent orders request (Consent Minute) form (DOCX, 31.11 KB), circulating it to the other parties and then sending it to the registry email. If consent is not forthcoming and still wish to seek an adjournment, you can complete an Application for orders in the proceeding form (PDF, 189.14 KB) and then sending it to the registry email.

Please ensure you include the reason/s for the hearing adjournment and how long you require the adjournment to. Please also ensure you copy in all other parties to the proceeding when emailing your request to the Board.

Please do not assume the hearing date will be changed. Your hearing will go ahead as originally planned unless we contact you to confirm a new date and time.

What is an administrative mention?

The purpose of an administrative mention is for the applicant or the parties to a proceeding to notify the Registrar of the status of the proceeding and their recommendations for the further conduct of the proceeding. There is no requirement to attend a hearing on this date.

I am a member of the public (not a party to a proceeding) and would like to attend a hearing. What should I do?

All hearings conducted are open to the public unless the Board has ordered otherwise. To view upcoming hearing listings, please see the details below. If you wish to attend a hearing, please put your request in writing and include the case number or property address and email it to the registry email. To ensure the Board can accommodate your request, please ensure your written request is submitted to the Board within 48 hours of the listed hearing.

Can I request an interpreter for my oral hearing?

The Board can arrange a professional interpreter for oral hearings at no cost to parties. If you require an interpreter for your oral hearing, please send your request to the registry email within 48 hours of the listed hearing. Please note the Board does not permit family or friends to translate during an oral hearing
